This Privacy Notice describes the privacy practices of Experian Background Data, Inc. (“Experian,” “EBD,” “we,” “us,” “our”) in connection with its preparation and processing of consumer reports. EBD is a consumer reporting agency subject to the federal Fair Credit Reporting Act and where applicable, the California Investigative Consumer Reporting Agencies Act (“ICRAA”). This notice does not apply to any other products or services within the Experian family of companies.

EBD may receive information about a consumer in response to an inquiry or request for a consumer report.

We may collect personal information from which you can be identified, such as your name, date of birth, postal and e-mail address, phone number, national identifier or social security number (as applicable).

EBD uses personal information, in connection with its consumer reporting activities for purposes permitted by the Fair Credit Reporting Act, the California and Investigative Consumer Reporting Agencies Act, and where applicable, internal business purposes, our product or service development and/or statistical analysis in accordance and consistent with applicable federal, state, local laws, rules, regulations and other applicable consumer reporting laws. EBD does not use consumer report information for marketing, advertising, or unrelated product development purposes.

In certain situations, we may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

As may be required by law, we may also disclose your personal information, for example, to comply with a subpoena, or similar legal process, when we believe in good faith that the disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request.

EBD maintains physical, electronic, and procedural safeguards designed to protect personal information against unauthorized access, use, or disclosure. Access to consumer report information is restricted to personnel with a business need to access the information.

Experian follows generally accepted standards and maintains physical, electronic and procedural safeguards to protect the personal data submitted to us. Experian continually monitors access to its systems to detect unauthorized attempts to gain access to information.

EBD retains copies of consumer reports and records associated with requests for those reports in accordance with applicable legal and regulatory record-retention requirements. Investigative consumer reports subject to ICRAA are retained for at least the period required by California law.

We are committed to adequately protecting the information that we collect from you. At this current time, the information that we collect from you in connection with this product or service will not be transferred to third parties outside of the United States or its territories. Should that change, this notice will be updated to reflect such change.  

We may update this Privacy Notice to reflect changes to our information practices or applicable legal requirements. If we make any material change to this Privacy Notice, we will notify you by means of a notice on this website.
