Louisiana HB 153 Change Notification

This bill requires claimants to perform at least five valid work search actions per week in order to qualify for benefits. Claimants may be disqualified from benefits if they fail to apply for or accept suitable work, miss a scheduled job interview or decline without good cause participation in approved training programs. This measure also requires the development of a form by the Administrator for Louisiana Department of Labor that allows employers to report suspected violations of any of the above, either online or in an electronic fashion. This is not a required act on the employer’s part however. It is recommended.

Louisiana House Bill 153 Implication to Stakeholders

Both of these are positive change for employers. Louisiana is cracking down on claimants’ eligibility issues surrounding the ease of virtual job interviews and electronic applications for employment. It has never been easier for claimants to find another job quickly. The second part of the bill is also good news because it could keep claimants from being eligible to receive benefits for any of these reasons. It does, however, require an employer to proactively notify the state about the particular infraction. While this could add to the employer’s workflow each day, in the end it should help with data integrity and reduce fraud.

Recommended Action

Employers should familiarize themselves with the state of Louisiana Department of Labor’s website to ensure they will be aware when the new form is in use.
