Regulatory Update: Syria Temporary Protected Status Termination

The Department of Homeland Security (DHS) has announced the termination of Syria’s designation for Temporary Protected Status (TPS). This decision follows a comprehensive review of country conditions and consultations with relevant U.S. government agencies. The Secretary of Homeland Security determined that Syria no longer meets the statutory requirements for TPS designation.

Key Dates and Implications

  • TPS Expiration Date:September 30, 2025
  • Termination Effective Date:November 21, 2025, at 11:59 p.m.
  • Affected Individuals:Syrian nationals and stateless individuals who last habitually resided in Syria

After November 21, 2025, individuals previously granted TPS under Syria’s designation will no longer be eligible for this protection. This change may impact employment authorization and Form I-9 compliance for affected employees.

Completing Form I-9

  • Form I-766, Employment Authorization Documents (EADs) with a category A12 or C19 and a Card Expires date of Sept. 30, 2025; March 31, 2024; Sept. 30, 2022; or March 31, 2021, issued under a prior TPS designation of Syria, expire on Nov. 21, 2025.
  • Employers must reverify TPS Syria beneficiaries who presented these EADs before they start work on Nov. 22, 2025.

Recommended Employer Actions

  • Reverify Form I-9:Employers must reverify employment authorization for Syrian TPS holders before the termination date. Use Supplement B and request updated documentation from affected employees.
  • Monitor E-Verify Alerts:Stay alert for notifications regarding expiring or revoked Employment Authorization Documents (EADs).
  • Avoid Discrimination:Ensure compliance with anti-discrimination provisions when requesting documentation.

Employers should prepare for potential workforce impacts and communicate clearly with affected employees. For further guidance, consult DHS and USCIS resources or legal counsel.
