Certain Venezuelan TPS beneficiaries may continue to have valid TPS status or employment authorization under limited circumstances:
- Individuals who received a TPS approval notice between January 17, 2025, and February 5, 2025, will retain TPS through October 2, 2026.
- Individuals issued a TPS-related Form I-94 during January 17, 2025, and February 5, 2025 period with an expiration date of October 2, 2026, may continue to hold TPS through that date.
- Individuals who received a TPS-based Employment Authorization Document (EAD) between January 17, 2025, and February 5, 2025, showing an expiration date of October 2, 2026, may continue to use that work permit until that date. However, possession of a valid EAD does not by itself extend TPS status or provide protection from removal proceedings.
- Individuals who timely filed a renewal application for a TPS-based EAD and received a receipt notice with a received date before February 6, 2025, may benefit from the automatic extension of employment authorization for up to 540 days beyond the expiration date listed on the card. This extension applies to work authorization only and does not extend TPS status.
Who No Longer Has Valid TPS or TPS-Based Work Authorization?
Unless one of the exceptions above applies:
- Individuals covered under the 2021 Venezuela TPS designation lost TPS and related employment authorization as of November 7, 2025.
- Individuals covered under the 2023 Venezuela TPS designation lost TPS and related employment authorization as of October 3, 2025.
Note: Employers should carefully review TPS-related documentation and applicable USCIS guidance when determining employment authorization eligibility for Venezuelan TPS beneficiaries.
