Louisiana SB 248 Change Notification

Several things are changing as a result of this bill.

  1. A Notice of Separation must now be filed electronically on the State of Louisiana’s portal striking out language that says it shall be “mailed or delivered”. This means the employer may only file the form in the portal.

The Notice of Separation can be mailed, delivered or transmitted to the separated employee within 10 days from the date of the separation.  This is an extension of the time period which was previously only three days.

Louisiana Senate Bill 248 Implication to Stakeholders

Employers who historically mailed, faxed or emailed this document to the state must now login to the state’s portal and submit the form within.  From there, the employer must print the completed document and send it to the former employee via email, USPS or some other form.  Employers are not required to electronically submit the form to the former employee. 

Recommended Action

Employers should make certain the interested personnel within their organization is aware of this change so no penalties may be assigned for failure to report or for reporting untimely.
