Update for Employers Regarding Afghanistan TPS

The Department of Homeland Security (DHS) announced that the Secretary of Homeland Security is terminating the designation of Afghanistan for Temporary Protected Status (TPS). After reviewing the country’s conditions and consulting with appropriate U.S. government agencies, the secretary determined that Afghanistan no longer meets the conditions for designation for TPS. The Secretary, therefore, is terminating the TPS designation of Afghanistan as required by statute.

Effective Date

Afghanistan’s designation for TPS is set to expire on May 20, 2025, and will be terminated at 11:59 p.m., local time, on July 12, 2025. After July 12, 2025, Afghan nationals (and aliens having no nationality who last habitually resided in Afghanistan) who have been granted TPS under Afghanistan’s designation will no longer have TPS.


Recommendations for Employers

  1. Pass an internal communication notifying employees of the recent update.
  2. Conduct aninternal I-9 audit to identify impacted employees.
  3. When Temporary Protected Status (TPS) for Afghanistan ends, employers should ensure they reverify Afghan TPS beneficiaries who presented List A or List C documents with specific expiration dates on their Form I-9 before they start work on July 13, 2025.
  4. Allow the employee to present analternative work authorization for Section 3 reverification.
