Regulatory Update: DHS Terminates TPS Designation for South Sudan

On November 6, 2025, the Department of Homeland Security (DHS), through USCIS, announced the termination of Temporary Protected Status (TPS) for South Sudan, effective January 5, 2026, at 11:59 p.m. Approximately 5,000 South Sudanese nationals residing in the U.S. under TPS status will be impacted.

Recommended Employer Action

I-9 Compliance & Employment Authorization

  1. EAD Validity Extended
    • Form I-766, Employment Authorization Documents (EADs) with a categoryA12 or C19and aCard Expires date of Nov. 3, 2025; May 3, 2025; or Nov. 3, 2023, issued under a prior TPS designation of South Sudan,expire on Jan. 5, 2026.
  2. Reverification Requirement
    • Employers mustreverifyemployment eligibility for South Sudan TPS beneficiaries presenting such EADsby January 6, 2026.
  3. Grace Period Considerations
    • The 60-day grace period beginning November 6, 2025, provides a window for employers toupdate Form I-9 recordsand make compliance adjustments.
